These Terms of Service ("Terms") govern your access to and use of Crediflow360, a credit lifecycle management platform developed and operated by Lebon Consulting (Pty) Ltd ("Lebon Consulting", "we", "us", or "our"), an authorised Financial Services Provider (FSP No. 52013) headquartered in Johannesburg, South Africa. By accessing or using Crediflow360, you confirm that you have read, understood, and agree to be legally bound by these Terms.

1. Introduction

Welcome to Crediflow360, a credit lifecycle management platform developed and operated by Lebon Consulting (Pty) Ltd.

2. Scope of Services

Crediflow360 is a Loan Management System (LMS) built on the Microsoft Cloud stack, designed for:

  • Banks and micro-lenders
  • Fintech providers
  • Co-operatives and developmental finance institutions
  • Credit providers regulated under South African law

Core functionality includes:

  • Digital loan origination and onboarding
  • Automated identity verification via the Department of Home Affairs
  • Real-time credit bureau checks
  • AI-powered credit decisioning
  • Loan servicing, monitoring, and reporting tools

3. User Responsibilities and Legal Compliance

3.1 Regulatory Compliance

You are solely responsible for ensuring that your use of Crediflow360 complies with all applicable South African laws and industry standards, including but not limited to:

  • The National Credit Act, 2005 (NCA)
  • The Protection of Personal Information Act, 2013 (POPIA)
  • SACCRA reporting standards

3.2 Responsible Party

Under POPIA, you are designated as the Responsible Party for any personal information you process through the platform. You must obtain lawful consent, provide appropriate disclosures, and take reasonable measures to safeguard client data.

4. Data Privacy and Security

We are committed to protecting your privacy. Crediflow360 utilises Microsoft Azure’s secure, encrypted infrastructure to host all data.

Your use of the platform is also subject to our Privacy Policy, which outlines how we collect, process, and protect personal information. By using the service, you agree to this policy.

5. Intellectual Property

All content, technology, and intellectual property associated with Crediflow360—including software code, UI/UX designs, documentation, logos, and trademarks—are the exclusive property of Lebon Consulting (Pty) Ltd. These may not be copied, modified, reproduced, or distributed without written permission.

6. Disclaimers and Limitation of Liability

Crediflow360 is provided on an "as is" and "as available" basis. While we strive for operational excellence and security, we make no warranties regarding uninterrupted or error-free use.

To the maximum extent allowed by law, Lebon Consulting shall not be liable for indirect, incidental, or consequential damages. Our total liability shall not exceed the fees paid by you for use of the platform over the past 12 months. These provisions comply with the Consumer Protection Act, 2008 (CPA) and are intended to be clear and reasonable.

7. Term, Suspension, and Termination

These Terms remain in effect for as long as you use the platform. We reserve the right to suspend or terminate access if:

  • You breach these Terms;
  • You use the platform for unlawful purposes; or
  • Legal or regulatory mandates require such suspension.

Termination does not relieve you of any obligations incurred prior to such termination.

8. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of South Africa. Any dispute arising from or related to these Terms shall be resolved through binding arbitration administered by the Arbitration Foundation of Southern Africa (AFSA) in Johannesburg in accordance with AFSA’s commercial arbitration rules.

9. Modifications

Lebon Consulting reserves the right to update these Terms from time to time. Changes will be communicated via email or through your Crediflow360 portal dashboard. Continued use of the platform constitutes your acceptance of any updates.

11. Entire Agreement

These Terms constitute the entire agreement between you and Lebon Consulting regarding the use of Crediflow360 and supersede any prior agreements, communications, or understandings.
